Personal Data & Privacy Policy


The personal data and privacy policy and practices of Popular Express Travel Sdn Bhd (hereafter referred to as PET) set out in this Personal Data & Privacy Policy (hereafter referred to as the Policy) shall apply to all services of PET available under the domain https://www.popularexpress.com (hereafter referred to as the PET website) and Popular Express Travel Mobile App (hereafter referred to as the PET Mobile App), via any mobile device or computer of any kind.  By visiting or using the PET website / PET Mobile App, you have agreed to be bound by the terms and conditions of the Policy.  If you do not agree to such terms and conditions, please do not use or access the PET website / PET Mobile App.

PET’s collection of your personal data is part of the normal operation of PET’s services. PET has developed this policy and practices on personal data and privacy matters and because PET believes that you should know as much as possible about such matters so that you can make informed decisions.


Notice

This written notice serves to inform you that your personal data is being processed by or on behalf of PET.  For the purpose of this written notice, the terms “personal data” and “processing” shall have the meaning assigned to them in the Personal Data Protection Act 2010 (hereinafter referred to as the “PDP Act”).


Description of your personal data

Your personal data processed by PET includes:

a)    Your personal details (such as name, gender, identification supporting documents (including NRIC or passport number), date of birth, country) and contact details (such as mailing address, e-mail address, and phone number);

b)    Your feedback information gathered from  multiple sources such e-mail, phone, write-in (e-mail);

c)    Your visit(s) to PET website/ PET Mobile App - - name of internet service provider, the website from which you visit PET website/ PET Mobile App, the pages and content which you view, the date and duration of your visit, cookies to track usage pattern, etc from the analytics tools such Google Analytics and others;

d)    Your personal interests and preferences to help PET design the offering of its services; and

e)    Information given voluntarily by you during any on-ground promotions or digital activities, tie-ups, contests, etc.


Purposes for processing of your personal data

PET may process your personal data collected from you or from any of the class of third parties stated in this Policy, for any one or more of the following purposes (hereinafter referred to as the “Purposes”):

a)    To verify your identity;

b)    To communicate with you and deliver to you information requested by you and/or, in some cases, is targeted to your interests, such as, administrative notices, targeted banner advertisements, product offerings, and communications which are relevant to your use of PET website/ PET Mobile App;

c)    To process any communication that you send to PET (for example, answering any queries, dealing with any complaints and/or feedbacks);

d)    To notify and/or invite you to events or activities organised by PET, its subsidiaries, partners or sponsors.

e)    To notify you about benefits, updates, changes to the features, promotions, alerts, newsletter,  promotional materials and special privileges, etc;

f)     To establish and organise PET customer loyalty programmes, where applicable;

g)    To establish and better manage any of the business relationship that PET may have with you.

h)   To help PET improve and monitor its services to you; namely PET overall service, staff training, quality assurance, our customer service team, PET website/ PET Mobile App and other related assets.

i)     To conduct marketing activities (for example, market research and surveys);

j)      To maintain records  required for auditing, security, claims and/or other legal purposes;

k)    To investigate and resolve any purchasing issues, queries, complaints or other enquiries that you may submit to PET regarding PET products and services through our customer service team or on-ground staff;

l)     To investigate, respond to, and/or defend claims made against, or involving PET and/or its relevant subsidiaries;

m)  For compliance with and/or any purposes required by any relevant law, directives, guidelines, orders, rules, regulations and requirements of any governmental or statutory authority or administrative or regulatory or supervisory body (including disclosure thereunder); and

n)   Any other purposes relating or incidental to any of the above.


Source of your personal data

Your personal data is collected directly from you when you:  

a)    Interact and communicate with PET and/or its related subsidiaries at any of its events or activities;

b)    Communicate with PET (for example when you contact PET for any enquiries including by getting in touch with PET customer service through any available PET channels);

c)    Register or subscribe for a specific service or publications of PET (for example, newsletters or register as a PET Mobile App Member);

d)    Participate in any of PET surveys, polls or other similar vehicles used to improve the content of PET website/ PET Mobile App, or used for PET marketing purposes;

e)    Enter or participate in any competitions, contests or loyalty programmes organized PET and/or its subsidiaries;

f)     Register your interest and/or request for information through PET online portals or other available channels;

g)    Respond to any marketing materials sent out by PET;

h)   Visit or browse PET website, PET Mobile App and any other PET owned platforms;

i)     Lodge a complaint with PET; and

j)      Provide feedback to PET (for example via e-mail or phone). Other than the personal data obtained from you directly as stated above, PET may also obtain your personal data from third parties which PET deals with or are connected with you; and from such other sources where you have given your consent for the disclosure of your personal data and/or where otherwise lawfully permitted.


Your rights

You have the following rights in relation to your Personal Data:

a)     To make a data request in writing to PET for information of your personal data that is being processed by or on behalf of PET (Section 30(2) of PDP Act);

b)     To correct any of your personal data which is inaccurate, incomplete, misleading or not up-to-date at any time on PET Mobile App by clicking on Edit Profile button after logging in;

c)     To limit the processing of your personal data including the personal data relating to other persons who may be identified from your personal data (Section 7(1)(f) of PDP Act).

d)     To unsubscribe to our marketing materials and/or correspondence by clicking the unsubscribe link contained in the emails and/or newsletters that PET sends to you and following the instructions therein; and

e)     To request for your personal data to be removed from PET database.

If you have any request in relation to the abovementioned rights under 7(a) or 7(c) above or any inquiries or complaints in respect of your personal data, please contact us.  PETmay refuse to comply with your data access request under the circumstances specified in the PDP Act and if PET does so, PET will inform you of its refusal and the reason(s) for its refusal.


Class of third parties to Whom PET may disclose your personal data 

This is the class of persons to whom PET may disclose your personal data:-

Service provider(s) for:

i.              The management of communications on PET’s behalf;

ii.            The arrangement and conducting of the events of PET, PET activities and PET services;

a)    Any third party or company that PET engages or appoints to conduct statistical analysis;

b)    Lawyers or legal firm for the enforcement of PET legal rights; and

c)    Such other authorities, bodies or parties when required by law.

Your obligations

It is obligatory for you to supply PET with your personal data and your failure to do so will result in PET being unable to process your personal data for any of the Purposes.

You will take reasonable steps to ensure that your personal data is accurate, complete, not misleading and kept up-to-date.


Security of your personal data

PET, when processing your personal data, takes practical steps to protect your personal data from any loss, misuse, modification, unauthorised or accidental access or disclosure, alteration or destruction including but not limited to the use of procedural and technical safeguards such as encryption, "firewalls" and secure socket layers. If you are aware of any security breach, please let us know as soon as possible. However, "perfect security" does not exist on the internet, so PET does not give an absolute assurance that your personal data that you provide to PET will be secure at all times; and PET will not be responsible for any event arising from unauthorised access to or theft of your personal data. PET will not be held responsible for events arising from third parties gaining unauthorised access to or theft by third parties of your personal data.

Retention of your personal data

PET will keep your personal data for the duration that is necessary to carry out the purpose for which your personal data was collected and also for the other purposes set out in this Policy.


Amendment to the Policy

PET reserves the right to amend this Policy at any time by posting an amended Policy containing such amendments on PET website/ PET Mobile App or by any other mode PET deems fit and suitable.

Users under the age of 18

The PET website/ PET Mobile App and its related services are not directed at persons under the age of 18.   If you are under the age of 18 years, you are required to obtain your parent/guardian's permission before you provide your personal data to PET and/or its related companies.


Conflict or Inconsistency

In the event of any conflict or inconsistency between the English language version and the Bahasa Malaysia version, the English language version shall prevail.

Others rights

For avoidance of doubt, nothing in this Policy shall limit such other rights of yourself or PET under the PDP Act.

Links to other websites    

When you use a link from PET website or PET Mobile App to another third party website, this Policy is no longer in effect. Once you have used such link, PET does not have any control over that other third party website; and PET cannot and shall not be liable or responsible for the protection and privacy of any personal data which you provided whilst visiting such website(s).  The browsing of and interaction by you on any other third party website(s) will be subject to the own rules and policies of that website concerned.
